TERMS AND CONDITIONS

1. OVERVIEW

Welcome to NAVOA.

The terms “NAVOA,” “we,” “us,” and “our” refer to the seller operating this online store under the NAVOA trade name.

These Terms and Conditions govern your access to and use of the NAVOA website, online store, products, content, features, and related services (the “Services”).

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products to you. Purchases made through this store are transactions between you and NAVOA, not Shopify.

By accessing our Services or placing an order, you agree to these Terms and Conditions together with the policies made available through our store, including our Privacy Policy, Returns & Refunds Policy and Shipping Policy.

Nothing in these Terms limits any mandatory rights that you have under applicable consumer protection law.

2. ELIGIBILITY AND CUSTOMER INFORMATION

You must have the legal capacity required under applicable law to enter into a purchase contract.

When placing an order, you agree to provide accurate, current and complete information, including your contact, billing and delivery information.

If customer accounts are available and you create one, you are responsible for keeping your account credentials secure and for activity carried out through your account.

3. PRODUCTS

We make reasonable efforts to describe and display our products accurately.

Product colours and appearance may vary slightly depending on your device, screen settings, lighting and other display conditions.

Minor variations that do not affect the advertised functionality or conformity of a product may occur where appropriate. Nothing in this section limits your rights if goods are defective, damaged, incorrectly supplied or otherwise fail to conform to the contract under applicable law.

We may update product descriptions, specifications and availability from time to time.

We may discontinue a product or limit availability where reasonably necessary, including because of stock limitations, delivery restrictions or legal requirements.

4. ORDERS AND CONTRACT FORMATION

By submitting an order, you offer to purchase the products shown in your order at the price and on the terms presented during checkout.

After you place an order, we may send an electronic confirmation containing your order details.

We may refuse or cancel an order where reasonably necessary, including in cases of:

  • product unavailability;

  • an obvious pricing or product-information error;

  • suspected fraud or unauthorised payment;

  • inability to deliver to the supplied address;

  • legal or regulatory restrictions.

If we cancel an order after payment has been taken, the relevant amount will be refunded using the applicable payment method.

Please review your order carefully before submitting it.

Where Shopify permits cancellation before fulfilment, you may request cancellation through the available process or by contacting NAVOA. Our ability to stop an order may depend on whether fulfilment has already begun.

Any cancellation limitation does not affect your statutory right of withdrawal or other mandatory consumer rights.

5. PRICES, TAXES AND PAYMENT

The price charged for a product is the price shown to you at checkout when the order is placed.

Prices displayed to consumers include applicable taxes where required by law.

NAVOA currently offers free standard delivery to supported destinations where stated in our Shipping Policy.

Any delivery charge or other mandatory amount payable by you will be disclosed before you complete your purchase.

Where our Shipping Policy states that an order is delivered using a duties-paid or equivalent method, the applicable delivery arrangement is governed by that policy.

Payment is processed using payment methods made available through Shopify and its payment partners.

You confirm that you are authorised to use the payment method submitted for your order.

We may change prices for future orders at any time. A later price change does not alter the agreed price of an order already placed and accepted.

6. SHIPPING AND DELIVERY

Shipping is governed by our Shipping Policy.

Estimated delivery times displayed by NAVOA are estimates and may vary because of destination, carrier operations, customs procedures or circumstances outside our reasonable control.

We will make reasonable efforts to deliver orders within the timeframe communicated to you and will provide tracking where stated in our Shipping Policy.

Where required by applicable consumer law, the risk of loss of or damage to goods remains with NAVOA until you, or a third party designated by you other than the carrier, take physical possession of the goods.

If an order appears lost, damaged in transit or materially delayed, please contact NAVOA so that we can investigate and provide the appropriate remedy.

Nothing in this section limits any rights available to you under applicable consumer law.

7. RETURNS, WITHDRAWAL AND REFUNDS

Returns, withdrawal requests and refunds are governed by our Returns & Refunds Policy.

Where applicable, consumers may have a statutory right to withdraw from an online purchase within 14 days without giving a reason.

For eligible change-of-mind returns, you may be responsible for direct return-shipping costs where this has been disclosed in advance and is permitted by law.

Different rules may apply where a product is damaged, defective, incorrectly supplied or otherwise does not conform to the contract.

Nothing in our Returns & Refunds Policy or these Terms restricts statutory rights or remedies that cannot lawfully be limited.

8. PRODUCT CONFORMITY AND STATUTORY RIGHTS

Products supplied by NAVOA must conform to the contract as required by applicable consumer law.

If a product is defective, damaged, incorrect or otherwise non-conforming, you may be entitled to remedies provided by applicable law.

Depending on the circumstances and applicable law, such remedies may include repair, replacement, price reduction or refund.

Any commercial statement or voluntary policy offered by NAVOA is in addition to, and does not replace, mandatory statutory consumer rights.

9. INTELLECTUAL PROPERTY

The NAVOA website and its original content, including text, graphics, photographs, videos, design elements, logos, product presentation and other materials, are owned by or licensed to NAVOA unless otherwise stated.

These materials are protected by applicable copyright, trademark and other intellectual property laws.

You may use the website for your personal, non-commercial use.

Unless permitted by law or expressly authorised by NAVOA, you may not reproduce, distribute, republish, sell, commercially exploit or create derivative works from protected NAVOA content.

Third-party names, trademarks and materials remain the property of their respective owners.

10. THIRD-PARTY SERVICES AND LINKS

Our Services may use or link to third-party services, including Shopify, payment providers, delivery providers and other service providers necessary to operate the store.

Third-party websites and services may be governed by their own terms and privacy policies.

Nothing in this section limits NAVOA's responsibility for obligations that remain ours under the contract with you.

11. SHOPIFY

Our online store is hosted by Shopify.

Shopify provides the technology that enables us to operate the store, but products purchased from NAVOA are sold by NAVOA.

Shopify may process certain information and provide checkout, payment, infrastructure and other services in accordance with its own applicable terms and privacy practices.

Nothing in these Terms creates a sales contract between you and Shopify for NAVOA products.

12. PRIVACY

Our collection and use of personal information are described in our Privacy Policy, available through the store.

Because our store is hosted on Shopify, certain personal information may also be processed by Shopify and other service providers required to operate our store, process payments, deliver orders, prevent fraud and provide customer support.

13. REVIEWS, FEEDBACK AND SUBMISSIONS

If you voluntarily submit a review, comment, image, suggestion or other feedback to NAVOA, you confirm that you have the right to provide that content and that it does not unlawfully infringe another person's rights.

Where you submit content for publication or promotional use, you grant NAVOA a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes connected with operating, improving and promoting NAVOA, subject to applicable law.

We may remove content that is unlawful, misleading, abusive, infringing or otherwise inappropriate.

Nothing in this section transfers ownership of your original content to NAVOA.

14. ACCEPTABLE USE

You may use the Services only for lawful purposes.

You must not intentionally:

  • use the Services for fraudulent or unlawful activity;

  • interfere with the security or normal operation of the website;

  • introduce malicious software;

  • attempt to gain unauthorised access to systems or accounts;

We may restrict access where reasonably necessary to protect the Services, customers or other parties from unlawful or harmful activity.

15. ERRORS AND AVAILABILITY

Despite reasonable efforts, information on the website may occasionally contain typographical errors, technical errors or inaccuracies relating to pricing, availability, product information or delivery information.

We may correct such errors when discovered.

If a material error affects an order you have already placed, we will contact you where appropriate and provide any remedy required by applicable law, including cancellation and refund where necessary.

We will not use this section to remove rights that you have under a valid consumer contract.

We aim to keep the Services available and functioning properly, but uninterrupted access cannot be guaranteed.

NAVOA does not exclude or limit liability where doing so would be unlawful.

If you use the products or Services for purposes outside ordinary personal or household use, additional legal rules may apply.

18. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL

We are not responsible for a delay or failure to perform an obligation where performance is prevented by circumstances outside our reasonable control, to the extent permitted by applicable law.

Such circumstances may include major carrier disruption, natural disasters, war, civil disturbance, governmental action, widespread infrastructure failure or other comparable events.

We will take reasonable steps to minimise the effect of such circumstances.

Nothing in this section removes any consumer remedy that continues to apply despite such an event.

19. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply only to the maximum extent legally permitted.

The remaining provisions will continue to apply where they can operate independently.

20. NO WAIVER

If NAVOA does not immediately exercise a right or remedy under these Terms, that does not mean that the right or remedy has been waived.

21. ENTIRE AGREEMENT AND POLICY PRIORITY

These Terms, together with the policies and information incorporated into the purchase process, form the agreement governing your use of the Services and purchases from NAVOA.

Where a specific NAVOA policy provides more detailed terms for a particular subject, such as shipping or returns, that specific policy applies to that subject.

Nothing in this section allows any policy to override mandatory consumer rights.

22. GOVERNING LAW AND CONSUMER PROTECTION

These Terms and purchases made through the NAVOA store are governed by applicable law.

If you are a consumer residing in the European Union or European Economic Area, nothing in these Terms deprives you of the protection provided by mandatory consumer-protection rules applicable to you, including mandatory protections that apply under the law of your country of habitual residence.

Changes do not retroactively alter rights and obligations arising from an order already concluded unless required or permitted by applicable law.

Where legally required, we will provide appropriate notice of material changes.
